• “Service” refers to the internet connectivity, telecommunications, cable TV, and associated digital services offered by Hubnexa Internet, including any resold services from third-party Internet Service Providers (ISPs).
• “User” or “Customer” refers to the individual or legal entity accessing the website or entering into a subscription agreement with Hubnexa Internet.
• “Content” refers to text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code provided on the Site.

2. Acceptance and Eligibility

The Services are intended solely for users who are eighteen (18) years of age or older. Any registration by, use of, or access to the Service by anyone under 18 is unauthorized, unlicensed, and in violation of these Terms of Service. By using the Service or Site, you represent and warrant that you are 18 or older and that you agree to abide by all of the terms and conditions of this Agreement.

Furthermore, because Hubnexa Internet may act as a referrer or reseller for third-party ISPs, service availability is strictly contingent upon your geographical location and the infrastructure capabilities of our partner networks.

3. Service Provisioning and Third-Party Relations

Hubnexa Internet operates, in part, as a facilitator connecting customers with major telecommunications networks. While we manage the customer relationship, billing, and support:

• Provider Acceptance: All orders placed through our platform are subject to final acceptance by the underlying local carrier.
• Installation: Timelines for installation are estimates. Hubnexa Internet is not liable for delays caused by third-party technicians, weather conditions, or property access issues.
• Service Speeds: Advertised speeds are “up to” speeds. Actual performance may vary based on network congestion, hardware limitations, and distance from the exchange.

4. Billing, Payments, and Taxes

You agree to pay all fees and charges associated with your subscription in accordance with the billing terms in effect at the time the fee or charge becomes payable.

4.1 Billing Cycle

Unless stated otherwise, fees are billed monthly in advance. You must provide a valid payment method. By providing such a method, you authorize us to charge all recurring fees to that method automatically.

4.2 Late Payments

Hubnexa Internet reserves the right to suspend or terminate access to the Services in the event of payment delinquency. A reactivation fee may be applied to restore services after suspension.

5. User Code of Conduct

As a condition of use, you promise not to use the Services for any purpose that is unlawful or prohibited by these Terms. You are responsible for all of your activity in connection with the Service. Prohibited activities include:

• Using the network to distribute malware, viruses, or harmful code.
• Attempting to bypass security protocols or reverse-engineer the Service.
• Hosting servers or high-traffic applications on residential plans without authorization.
• Harassing, abusing, or threatening Hubnexa Internet support staff.

6. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Hubnexa Internet, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your transmissions or content.

7. Indemnification

You agree to defend, indemnify, and hold harmless Hubnexa Internet and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

8. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any dispute arising from these terms shall be resolved exclusively in the courts located within Casper, Wyoming. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
